"If they are criminals, there are established legal grounds for deportation," Pitt added.
The federal government, however, presents a different narrative. They claim that this initiative, an extension of President Trump's immigration policies, offers young immigrants a choice and a way to control their future. The Department of Homeland Security (DHS) states that unaccompanied minors are often victims of trafficking by drug cartels.
"Officials have been working hard to ensure the safety and well-being of these children," DHS said in a statement. They further explained that financial support is offered to those who voluntarily return to their home countries, with payments made after an immigration judge's approval.
But the question remains: are these minors truly making an informed decision, or are they being coerced under the threat of family arrest?
According to Voices for Utah Children, an advocacy group, 198 unaccompanied minors have been released to sponsors in Utah this year, and they fear these children may be affected by the new policy. The group's statement expressed concern over the potential intimidation and violation of due process.
"We are troubled by the thought of children as young as 10 being pressured to waive their legal rights and protections," the statement read.
And this is the part most people miss: the Trump administration's focus on public safety and criminal backgrounds often overlooks the fact that unaccompanied minors are typically not dangerous. T. Laura Lui, another Murray-based immigration attorney, emphasized that these minors are fleeing danger and persecution in their home countries.
"They are seeking safety, not causing harm," Lui said.
The attorneys' concerns are further heightened by the lack of specific enforcement actions since the operation's announcement. However, Pitt believes that a previous attempt to fly Guatemalan minors back to their country may have been a trial run for the current policy.
